The federal ban is averted. TikTok stays on.
If you're a creator, this sounds like good news. And it is — sort of. But the framing of "TikTok is saved" obscures a more important question that the USDS deal does nothing to answer:

What the USDS Deal Actually Changed
The TikTok USDS Joint Venture LLC is a new legal entity. Here is what it controls:
- US user data storage (now on Oracle cloud infrastructure in the US)
- Content moderation for US users
- Algorithm security and software assurance

Here is what it did not change:
- The algorithm that decides which creators get distribution — still proprietary, still opaque
- The ability of the platform to suspend or ban individual creator accounts

- The terms of service that grant TikTok broad license to use, distribute, and control content
- ByteDance's 19.9% stake and its ongoing involvement in the platform's global operations
The deal fixed the specific problem of Chinese government access to US user data. It did not fix the structural relationship between creators and the platform — because that relationship was never the problem the deal was designed to solve.
The Risks That Survived the Deal
Risk 1: Your account can still be banned without warning
The USDS deal has no bearing on TikTok's content moderation decisions. Accounts are still suspended by automated systems, still appealed through an opaque process, and still lost permanently when appeals fail. The new American board governs data and security — not creator account status.
Risk 2: The algorithm still controls your reach
ByteDance's algorithm is what made TikTok what it is — and it is still the algorithm running on your content.
